​This Privacy Policy describes how VriddhiGather Campaigns India Private Limited (hereinafter referred to as “we”/“us”/“our”) manages your Personal Data in compliance with the Indian Laws, including the Digital Personal Data Protection Act, 2023 (hereinafter referred to as “DPDPA”), along with other jurisdictional data privacy laws such as the General Data Protection Regulation (hereinafter referred to as “GDPR”) and the California Consumer Privacy Act (hereinafter referred to as “CCPA”).

For purpose of this Policy, “you” or “your” means any visitors to our website, or any natural person whose “Personal Information” is collected by us in any manner. We encourage you to read this Privacy Policy so that you know and understand the purposes for which we collect, use, process, store and disclose your Personal Data in a restricted manner. Our privacy practices are subject to applicable laws in the places in which we operate. This means that we engage in the practices described in this notice in a particular country or region only if permitted under the laws of those places.

Such information includes the categories of personal information defined in the CCPA:

ii. Financial information, such as bank routing numbers, tax information, and any other payment information you provide;

iii. Geolocation data, including precise geolocation data;

By signing up for or using any services or campaigns offered by Gather Campaigns Limited or submitting information to or otherwise communicating Gather Campaigns Limited, you agree and consent to collecting, using and disclosing your Personal Data in accordance with the purposes laid down in the Privacy Policy. However, please note that separate consent shall be sought again in case Gather Campaigns Limited is required to process and/or disclose your Personal Data for any purpose(s) over and above those enumerated in this Privacy Policy.

This Privacy Policy does not supersede or replace any other consents which you may have previously or separately provided to us in respect of your Personal Data and your consent to this Privacy Policy is in addition to any other rights which any of the Companies may have at law to collect, use or disclose the Personal Data.

1. What data do we collect?

Transactional Data and Information: Personal information related to consumers those purchase products or services through our campaigns, details of a particular transaction as well as information generated from a person’s engagement with any of our clients, in some instance it can include an audio recording of the transaction;

Compliance and Operational Information: Personal Information related to our subcontractors (and their employees commonly known as “Agents”) and data generated from those individuals and information which known as “background check” as provided by a consumer reporting agency, information can also include facial photographs which are used by our subcontractors;

Information Generated from Our Website: Includes “Cookies”, which are the text files that websites store on a visitor’s device to identify the visitor’s browser or to store information or settings in the browser to track activity and patterns, web beacons and other tracking technologies which demonstrate that a user has accessed or opened certain content or that the content was viewed or clicked.

Our website and mobile application tracking tools also collect information like your IP, Location, Website clicks in anonymized format and aggregates this data.

3. How do we use your data?

Please note that the same shall considered as “Certain Legitimate Uses” under Section 7 of the DPDPA or “Legitimate Interests” under Article 6 of GDPR, as applicable.

 

i. To prevent, investigate, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law.

 

ii. In the interest of public health or public interest.

 

iii. For safeguarding itself from loss or liability such as prevention of corporate espionage, maintenance of confidentiality of trade secrets, intellectual property, classified information, etc.

 

iv. To confirm to legal requirements, or to respond to lawful Court orders, subpoenas, notices, warrants, or other requests by public authorities (including to meet national security or law enforcement requirements).

 

v. Personal information may also be shared with the company that acquires our business, whether through merger, acquisition, bankruptcy, dissolution, reorganization, or other similar transaction or proceeding. If this happens, we will display a prior notice on our Website.

 

Please note that we shall not transfer your personal data with any third parties, excluding the above reasons, for any purposes whatsoever, and will seek your explicit consent as and when required.

6. Consent To Personal Data Transfer

We are based in the India and other Countries (such as USA, UK) and may process, store, and transfer the personal data we collect, in and to a country outside your own (except such territory or country which is notified as restricted by the Government), with different privacy laws that may or may not be as comprehensive as your own.

By submitting your personal data or engaging with the website, you consent to this transfer, storing, or processing.

7. What happens if you do not provide us with the information, we had asked you for or if you ask us to stop processing your information?

Where it concerns processing operations related to the business relationship with you, we will not be able to adequately establish, conduct or terminate a business relationship with you and generally perform the purposes described above without certain data.

Although we cannot obligate you to share your personal data with us, please note that this then may have consequences which could affect the business relationship in a negative manner, such as not to establish and continue the business relationships you have asked for.

 

Subsequently, in case you rescind or withdraw your consent, kindly send us an email at privacy.gatherindia@gathercampaigns.com and we would immediately stop processing your Personal Data. We will also erase all kinds of Personal Data which has been provided by you under this Policy, available at our end.

Post deletion and erasure of the Personal Data, we would duly notify you the same in writing. This entire process shall be completed by us within 15 (fifteen) days.

 

8. How do we safely store your data and for how long?

We take appropriate security measures to protect your data from being accidentally lost, used or accessed by unauthorized sources. We limit access to your personal data to employees within the organization, subcontractors, agents, and to those with a legitimate business or industry need.

 

We will only retain your data for stipulated time of 3 (three) years to fulfil the purposes, we collected it for, including for the purposes of satisfying any legal, accounting, audit, or reporting requirements or until you notify us that you no longer wish to receive the services and storage/consultation facilities provided by us.

In general, customer related personal data is kept for the duration of the contractual relationship for which you have given your due consent, or for a minimum period of 3 (three) years, or for a shorter/longer period if required by local laws and regulatory requirements only.

 

For data provided to us by our clients, we are governed by their data retention rules as specified in their privacy notices.

 

Through the setting of IT applications and policies, we ensure that our keeping of your personal data is deleted when we no longer need it.

9. What we do not do with your Data?

We strictly refrain from sharing, disclosing, selling, renting or otherwise provide personal information to other companies (other than to our specific marketplace administrators you are interacting with, or to third party apps or service providers being used by the administrators you are interacting with) for the marketing of their own products or services.

10. Processing of Personal Data of a Minor

 

We do not direct our website to minors and we do not knowingly collect personal data from children under 18 years of age or as defined by local legal requirements. If we learn we have mistakenly or unintentionally collected or received personal data from a child without appropriate consent, we will delete it. In the event for any business purpose, we are bound to collect any personal data of a minor, i.e., below 18 years of age, we shall obtain parental consent from the minor’s lawful guardian or parents, and further verify such consent by means of ID Proofs, as mandated under the provisions of the DPDPA, read with GDPR and CCPA, as applicable.

 

11. What is your data protection rights?

i. Right to access your data: You are entitled to ask us for an overview of, or to obtain a copy of the personal data we hold about you.

 

ii. Right to have your data corrected: You may request immediate rectification of any inaccurate or incomplete personal data we hold about you by sending us an email at privacy.gatherindia@gathercampaigns.com.

 

iii. Right to have your data erased: You may request the personal data to be erased when it is no longer needed, where applicable law obliges us to delete the data or the processing of it is unlawful. In the event you want your personal data to be erased, please send an email requesting the erasure at

iv. Right to object to data processing: You have the right to object to our processing of your personal data, where we rely on our legitimate interests, as the basis for our processing, where your data protection rights outweigh our reasoning for legitimate interests.

 

v. Right to withdraw consent: Where we have asked for your consent to process personal data, you may withdraw your consent at any point of time. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

 

vi. Right to be informed: About how the data is used which is being collected from you.

 

vii. Right to information about other Data Fiduciaries and Data Processors: You can ask for the information about all other Data Fiduciaries and Data Processors with whom the personal data has been shared by us, if any, along with a description of the personal data so shared.

It is exclusive property of “Gather Campaigns Limited”. No part of the same can be reproduced, copied, shared, altered, photocopied, etc., in any direct or indirect manner whether directly or indirectly.
